However, if a bad tenant causes a lot of problems in the property, a landlord would have no other option but to\u00a0file an eviction lawsuit\u00a0(a.k.a. unlawful detainer) against him.<\/p>\n\n\n\n<p>If you are a landlord experiencing problems with a horrible tenant and you are on the verge of filing an eviction lawsuit, you have to first make sure that you increase your odds of winning the case.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/09\/pexels-andrea-piacquadio-3771129-1024x682.jpg\" alt=\"\" class=\"wp-image-1247\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/09\/pexels-andrea-piacquadio-3771129-1024x682.jpg 1024w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/09\/pexels-andrea-piacquadio-3771129-300x200.jpg 300w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/09\/pexels-andrea-piacquadio-3771129-768x512.jpg 768w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/09\/pexels-andrea-piacquadio-3771129.jpg 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Knowing these common mistakes landlords made in the past that caused them to lose eviction cases is one way to check if you have a strong chance of successfully evicting your tenant if you ever decide to sue.<\/p>\n\n\n\n<h2>Not serving a Notice to Quit properly.<\/h2>\n\n\n\n<p>To start an eviction process, you have to serve the tenant being evicted with a\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/notice-to-quit-how-to-legally-evict-a-tenant\/\" target=\"_blank\" rel=\"noreferrer noopener\">Notice to Quit.<\/a> The notice will inform the tenant that you will file an eviction lawsuit if he fails to vacate the property on or before a certain date.\u00a0<\/p>\n\n\n\n<p>If the court finds out that you failed to serve him the notice, or failed to give him enough time to vacate the premises based on what state housing laws require (usually 3 days), the court will not rule in your favor and the tenant gets to stay.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/08\/final-4896425_1280-1024x682.jpg\" alt=\"\" class=\"wp-image-1077\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/08\/final-4896425_1280-1024x682.jpg 1024w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/08\/final-4896425_1280-300x200.jpg 300w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/08\/final-4896425_1280-768x512.jpg 768w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/08\/final-4896425_1280.jpg 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>A Notice to Quit can also be deemed defective by the court if it lacks any of the components required by law such as the legal name of the tenant, the address of the property, a&nbsp;legal reason for eviction, etc.&nbsp;<\/p>\n\n\n\n<h2>Accepting Partial Rent<\/h2>\n\n\n\n<p>When the tenant is being evicted because of non-payment of rent and you accept his offer to pay\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/when-to-accept-or-deny-partial-payments-and-how-to-do-it\/\" target=\"_blank\" rel=\"noreferrer noopener\">partial rent<\/a>, it can mean that you are waiving the 3-day Notice to Pay or Quit,\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/instances-when-notice-of-eviction-can-be-cancelled\/\" target=\"_blank\" rel=\"noreferrer noopener\">canceling the eviction process<\/a>.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"1024\" height=\"682\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/06\/pie-chart-835976_1280-2-1024x682.jpg\" alt=\"\" class=\"wp-image-697\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/06\/pie-chart-835976_1280-2-1024x682.jpg 1024w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/06\/pie-chart-835976_1280-2-300x200.jpg 300w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/06\/pie-chart-835976_1280-2-768x512.jpg 768w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2020\/06\/pie-chart-835976_1280-2.jpg 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h2>Lease clause of no-cap attorney&#8217;s fees<\/h2>\n\n\n\n<p>A no-cap on attorney&#8217;s fees clause in your\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/lease-agreements-what-should-be-included\/\" target=\"_blank\" rel=\"noreferrer noopener\">lease agreement<\/a>\u00a0can be your downfall. An agreement to this clause means that if you and the tenant will have a\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/the-most-common-lawsuits-landlords-file-against-tenants\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal battle<\/a>\u00a0in the future, whoever loses will pay for the winner&#8217;s attorney&#8217;s fee.\u00a0<\/p>\n\n\n\n<p>As a landlord, this could financially harm you especially in an eviction lawsuit, which can easily be lost just because of mere technical mistakes. A lot of good legal-aid lawyers would also be more than willing to help your tenant win the case when they know that they can get a hefty amount from you. Even if you win the case, if the reason for eviction is due to non-payment, the tenant will most probably have no money to pay for your attorney&#8217;s fees.&nbsp;<\/p>\n\n\n\n<p>If you still want to have a clause on attorney&#8217;s fees on your lease agreement, cap it to just $700 or less.&nbsp;<\/p>\n\n\n\n<h2>Lack of Evidence<\/h2>\n\n\n\n<p>If you&#8217;re evicting a tenant due to lease violations, make sure you have the original lease agreement that you signed, proof of the lease violation (e.g. photos of\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/damages-that-do-not-count-as-usual-wear-and-tear\/\" target=\"_blank\" rel=\"noreferrer noopener\">property damage<\/a>), and\u00a0<a href=\"https:\/\/www.padleads.com\/blog\/documents-that-you-should-keep-if-you-are-a-landlord\/\" target=\"_blank\" rel=\"noreferrer noopener\">documents of all transactions<\/a>.
