Its contents, format, and use vary from province to province. However, the purpose is mostly the same: outline the terms in a rental home which would serve as guidelines for tenants and their landlords.<\/p>\n\n\n\n<p>In previous articles, we have discussed the Standard Lease for the provinces of <a href=\"https:\/\/www.padleads.com\/blog\/canadian-leasing-agents-guide-to-standard-lease-agreements-per-province-ontario-and-quebec\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ontario, Quebec<\/a>, <a href=\"https:\/\/www.padleads.com\/blog\/canadian-leasing-agents-guide-to-standard-lease-agreements-british-columbia-and-alberta\/\" target=\"_blank\" rel=\"noreferrer noopener\">British Colombia, Alberta<\/a>, <a href=\"https:\/\/www.padleads.com\/blog\/canadian-leasing-agents-guide-to-standard-lease-agreements-per-province-manitoba-and-saskatchewan\/\" target=\"_blank\" rel=\"noreferrer noopener\">Manitoba, and Saskatchewan<\/a>. This article will focus on the Standard Lease in Nova Scotia, Newfoundland and Labrador, and Brunswick.<\/p>\n\n\n\n<h1>Nova Scotia<\/h1>\n\n\n\n<p>The Nova Scotia Standard Form of Lease (a.k.a. &#8220;Form P&#8221;) is not mandatory, unlike some standard leases in other provinces. However, even if not used, the conditions in Form P will apply. On the other hand, even if there will be another lease or verbal agreement between the landlord and tenant, they can still use Form P.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"640\" height=\"512\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/livia-widjaja-VuO467wMZQI-unsplash.jpg\" alt=\"\" class=\"wp-image-3271\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/livia-widjaja-VuO467wMZQI-unsplash.jpg 640w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/livia-widjaja-VuO467wMZQI-unsplash-300x240.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure><\/div>\n\n\n\n<h3>Information required in Form P<\/h3>\n\n\n\n<p>Form P must contain the following information to be used in settling disputes between landlords and their tenants in the future:<\/p>\n\n\n\n<p>\u2022 Full name of the tenant, including that of adults and children who will live with them<br>\u2022 Phone numbers of tenants<br>\u2022 Email addresses of tenants<br>\u2022 Emergency contacts (e.g., the number of the tenant&#8217;s family member)<br>\u2022 The contract terms, including the move-in date and lease duration. It should also include how long the agreement lasts (i.e., weekly, monthly, daily, or fixed-term)<br>\u2022 Rental price<br>\u2022 A list of utilities, services (e.g., cleaning), and appliances included in the rent<br>\u2022 Tenant responsibilities (e.g., repairs, maintenance). If the tenant is not responsible for them, indicate the contact details of the one assigned for such tasks.<br>\u2022 The amount of security deposit, which should not exceed half a month&#8217;s rent. Landlords in Nova Scotia must keep the security deposit in an interest-bearing trust account within two banking days upon collection.<br>\u2022 Other rules (e.g., smoking, pets, etc.)<\/p>\n\n\n\n<h1>New Brunswick<\/h1>\n\n\n\n<p>Like Nova Scotia&#8217;s Form P, Form 6 or The New Brunswick Residential lease Standard Form of Lease is not mandatory. However, the Residential Tenancies Tribunal firmly recommends its use. They also require both landlords and tenants to have an original signed copy of Form 6. Even without the form, the Residential Tenancies Act still applies to tenants. A verbal or implied lease is also legally binding. However, it should have a written notice.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"640\" height=\"427\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/kelsey-k-kEzKzp453jY-unsplash.jpg\" alt=\"\" class=\"wp-image-3272\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/kelsey-k-kEzKzp453jY-unsplash.jpg 640w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/kelsey-k-kEzKzp453jY-unsplash-300x200.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure><\/div>\n\n\n\n<p>Landlords may add reasonable obligations and rules before signing a lease. If there are rules that contradict the Residential Tenancies Act, they will be overridden.<\/p>\n\n\n\n<p>Other things to know about leases are:<br>\u2022 It still holds even if the landlord sells the rental property.<br>\u2022 Leases end at midnight.<br>\u2022 They can be either a <strong>periodic lease<\/strong> (automatically renews when it ends: weekly tenancy, monthly tenancy, or yearly tenancy) or a<strong> fixed-term lease<\/strong> (has a fixed start date and end date).<\/p>\n\n\n\n<h3>Information required in Form 6<\/h3>\n\n\n\n<p>\u2022 The name, address, and contact information of the tenant\/s and landlord\/s<br>\u2022 The address of the rental property, type of unit, permitted use, and other reasonable rules (e.g., smoking, pets, etc.)<br>\u2022 Duration and type of tenancy, as well as the tenancy&#8217;s date of expiration<br>\u2022 Amount of rent<br>\u2022 Schedule and mode of payment.<br>\u2022 Rent increase details<br>\u2022 Late rent fees<br>\u2022 A list of utilities, services (e.g., cleaning), furnishings, and appliances included in the rent<br>\u2022 The security deposit amount, which should usually not exceed a month&#8217;s rent<br>\u2022 Information on subletting and assignment<br>\u2022 Signatures of all parties involved in the contract<\/p>\n\n\n\n<h1>Newfoundland and Labrador<\/h1>\n\n\n\n<p>Under Section 7 of the Residential Tenancies Act of 2018: the Newfoundland and Labrador Standard Rental Agreement Form is mandatory.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" width=\"640\" height=\"480\" src=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/erik-mclean-KLh6lOElwS0-unsplash.jpg\" alt=\"\" class=\"wp-image-3274\" srcset=\"https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/erik-mclean-KLh6lOElwS0-unsplash.jpg 640w, https:\/\/www.padleads.com\/blog\/wp-content\/uploads\/2022\/04\/erik-mclean-KLh6lOElwS0-unsplash-300x225.jpg 300w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure><\/div>\n\n\n\n<p><strong>The form must include:<\/strong><\/p>\n\n\n\n<p>\u2022 Full legal names of the landlord\/s and tenant\/s<br>\u2022 Phone number, email, and home address of the landlord or his agent where tenants can serve or deliver documents.<br>\u2022 Address of the rental unit<br>\u2022 Date when the agreement was signed<br>\u2022 Start date of the tenancy<br>\u2022 Type of rental agreement: periodic, weekly, monthly, fixed term<br>\u2022 The end date, if fixed-term<br>\u2022 Amount of rent, frequency of payment, and due dates<br>\u2022 Terms of use for services, furniture, appliance, and utilities included in the rent<br>\u2022 Security deposit amount not exceeding half a month&#8217;s rent.<br>\u2022 Date of collection of the security deposit<\/p>\n\n\n\n<p>Landlords must provide the tenant\/s with a copy of the signed agreement. If there is only a verbal agreement, there must be a written notice that acknowledges it. Landlords must also give their tenant\/s a copy of the Residential Tenancies Act.<\/p>\n\n\n\n<p>As a Canadian rental agent, you must know the standard lease forms in the province where you do business. It would better equip you, especially when you start receiving applicants for a listing you published on <a href=\"http:\/\/www.padleads.com\" target=\"_blank\" rel=\"noreferrer noopener\">Padleads<\/a>.
